Terms of Service & EULA

This Agreement is solely between you and Radex LLC. The Service is distributed through the Apple App Store and the Google Play Store (each, a "Platform Provider"). Radex LLC, not Apple Inc. ("Apple") or Google LLC ("Google"), is solely responsible for the Service, its content, and all functionality. You acknowledge that Apple and Google have no obligation or liability to you whatsoever with respect to the Service, including but not limited to any warranty, maintenance, support, or product liability obligation. Any claims, losses, or disputes arising from the Service shall be directed exclusively to Radex LLC, not to Apple or Google.

These Terms incorporate by reference the Apple End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent of any conflict between the Apple EULA and these Terms with respect to your use of the Service on an Apple device, these Terms shall control.

You must be at least 13 years of age to use the Service. By registering an account, you represent and warrant that you meet this age requirement, that all information you provide is accurate and complete, and that you possess the legal authority to enter into this Agreement.

Export & Sanctions Compliance: You represent and warrant that you are not located in, under the control of, or a national or resident of any country that is subject to a United States government embargo or other comprehensive sanctions program, and that you are not listed on any United States restricted party list, including but not limited to the Specially Designated Nationals and Blocked Persons List maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the Denied Persons List or Entity List maintained by the U.S. Department of Commerce, or any other U.S. government restricted or denied party list. You further represent that you will not use the Service in violation of any applicable U.S. export control or sanctions laws.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use or security breach. You may update your profile information at any time within the app. You are solely responsible for any content posted under your account.

Subject to your compliance with these Terms, Radex LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on a mobile device or web browser that you own or control, solely for your personal or commercial use in connection with trading card collecting. This license does not include any right to resell, sublicense, redistribute, or commercially exploit the Service or any portion thereof without prior written consent.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, or international law
• Submit false or misleading show information, card listings, or acquisition records
• Impersonate another person, vendor, or business
• Upload content that is illegal, hateful, harassing, or infringes on intellectual property rights
• Attempt to access data belonging to other users without authorization
• Use automated systems (bots, scrapers) to extract data from the Service
• Interfere with or disrupt the Service's servers, APIs, or features
• Reverse engineer, decompile, or disassemble any portion of the Service

The Service allows users and vendors to submit, post, and display content, including but not limited to card photos, inventory listings, show submissions, booth check-ins, acquisition records, display names, and profile photos ("User-Generated Content" or "UGC"). You retain ownership of the UGC you submit. By submitting UGC, you grant Radex LLC a worldwide, royalty-free, non-exclusive, transferable, sub-licensable license to host, store, display, reproduce, and distribute that content within the Service as necessary to operate its features.

You are solely responsible for the UGC you submit and represent that you hold all necessary rights to do so without infringing on the rights of any third party.

Content Moderation & Enforcement: Radex LLC reserves the right, in its sole discretion, to flag, block, hide, or delete any UGC that it determines violates these Terms, its community standards, or applicable law, and to suspend or permanently ban any user or vendor who engages in abusive, fraudulent, harassing, or prohibited conduct. Such enforcement actions may be taken immediately and without prior notice. Any subscription fees paid by a suspended or banned user are strictly non-refundable, and no refund or credit shall be issued for access revoked due to violations of these Terms.

Radex offers the following subscription tiers, each granting the features described in the app's plan comparison:

• Radex Pro (Monthly): $7.99 per month — unlocks live market comps, extended Want List capacity, and additional premium collector features.
• Radex Pro (Annual): $59.88 per year ($4.99/mo, billed annually) — includes all Radex Pro features at a discounted annual rate.
• Verified Vendor — Founder's Tier: $14.99 per month or $149.00 per year — available during the first 3 months after launch and locked in for life while the subscription stays continuously active. Grants a verified badge, priority placement on Collector Radars, and access to the affiliate referral program.
• Verified Vendor — Standard Tier: $19.99 per month or $199.00 per year — the standard Verified Vendor rate, available after the Founder's window closes (or to returning former Founders who previously canceled).

Payment Processing: Subscription payments are processed through Apple In-App Purchases (for iOS users), Google Play Billing (for Android users), and Wix/Stripe (for web users), depending on the platform from which you subscribe. Radex LLC does not directly receive, process, or store your full payment card information.

Auto-Renewal & Cancellation: All subscriptions automatically renew at the end of each billing cycle unless auto-renewal is turned off at least 24 hours before the end of the current period. Subscription management, auto-renewal settings, and cancellations are handled exclusively by the respective platform (Apple App Store, Google Play Store, or Wix/Stripe) through your account settings on that platform. Turning off auto-renewal must be done through the same platform where the subscription was purchased. Upon cancellation, access to the subscribed features continues until the end of the current billing period, after which the subscription will not renew.

Refunds: Refunds for subscriptions purchased via Apple or Google are governed solely by Apple's and Google's respective refund policies and must be requested directly through those platforms. Refunds for web subscriptions are evaluated at Radex LLC's sole discretion. No refund is owed for access revoked due to violations of these Terms.

Pricing Changes: Radex LLC reserves the right to adjust subscription pricing. Any price changes will take effect at the start of your next billing cycle following notice provided through the app or via email. Continued use of the Service after the effective date of a pricing change constitutes acceptance of the new price.

If you use Radex as a vendor, you agree to:

• Provide accurate booth display names, table numbers, and aisle locations when checking in at shows
• List cards for sale with honest descriptions of condition, grading, and authenticity
• Comply with all applicable laws regarding the sale of trading cards, including accurate representation of card authenticity and condition
• Not list counterfeit, reproduced, or fraudulent cards as authentic

Radex LLC reserves the right to revoke vendor access, remove listings, or terminate vendor accounts for violations of these Terms without refund, as described in Section 6.

The Service displays live market valuations and pricing data sourced from third-party services, including eBay sold listings and TCGplayer. All such market valuations and pricing data are provided "as is" and strictly for informational purposes only. Radex LLC does not guarantee the accuracy, completeness, timeliness, or reliability of any market data displayed in the Service.

You acknowledge and agree that Radex LLC shall not be liable for any financial losses, lost profits, or economic harm arising from your reliance on market valuations or pricing data displayed in the Service. You are solely responsible for independently verifying card values, market prices, and the authenticity and condition of any card before making any purchase or sale decision.

Radex LLC is not liable for the outcome of any trade, transaction, or negotiation conducted between users, vendors, or third parties — whether initiated through or independent of the Service. Radex LLC is not a party to any transaction between users and vendors and does not facilitate, guarantee, or escrow any payment for goods exchanged.

Radex LLC is not responsible for any physical interactions, disputes, altercations, or personal injuries that occur at card shows, in-person meetups, or any other physical location, whether or not such interactions were facilitated or organized through the Service. You assume all risk associated with attending card shows and interacting with other users in person.

Card show listings are submitted by the community and may not always be accurate or up to date. Radex LLC is not responsible for cancelled shows, incorrect addresses, or changes to show schedules. Always verify show details with the official show organizer before traveling.

The Radex name, logo, app design, source code, and all original software are the exclusive property of Radex LLC and are protected by United States and international intellectual property laws. Card images and card metadata displayed in the Service are sourced from third-party databases and remain the property of their respective rights holders. Nothing in these Terms grants you any right to use the Radex name, logo, or trademarks without prior written consent.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Radex LLC does not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. You use the Service entirely at your own risk.

To the fullest extent permitted by applicable law, in no event shall Radex LLC, its officers, directors, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service — whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Radex LLC has been advised of the possibility of such damages. In no event shall Radex LLC's total aggregate liability to you for all claims arising out of or related to the Service exceed the total amount you have paid to Radex LLC for the Service in the twelve (12) months preceding the event giving rise to the claim.

The limitations and exclusions in this Section apply even if any remedy fails of its essential purpose, as further described in Section 9 with respect to market data, trades, and physical interactions at card shows.

You agree to indemnify, defend, and hold harmless Radex LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your UGC, your violation of these Terms, your violation of any law or the rights of any third party, or your misuse of the Service.

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including if you violate these Terms. You may delete your account at any time directly within the app by navigating to Settings > Delete Account. Upon termination, your right to use the Service ceases immediately, and any active subscription will not be refunded except as required by applicable law or the respective platform's refund policy. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, indemnification) shall remain in effect.

Radex LLC may update or modify these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Effective Date" above. Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

These Terms and any dispute arising out of or related to the Service shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law principles. You and Radex LLC irrevocably submit to the exclusive jurisdiction of the state and federal courts located in the State of Tennessee for the resolution of any dispute, claim, or proceeding arising out of or relating to these Terms or the Service, and you waive any objection to venue or inconvenient forum in such courts.
